• Our tour is an “active participation” activity. We recommend that you be able to easily climb stairs and you can stand from a seated position without difficulty. This tour is not appropriate for those with recent/chronic back or knee issues and participants must be able to raise their arms above their head.
  • If you have a medical condition of any kind which limits your physical activity you must notify us prior to the tour.
  • You may NOT participate in the tour IF:
    • You are or think you may be pregnant;
    • You are under the influence of alcohol, illegal drugs, or legal drugs that impair you in any way.

Tours, like other recreational adventures, carry inherent risks. Please note your Client Responsibilities:

  • All clients will be required to follow the safety policies and procedures of Unquote Travel and the guides’/travel leaders’ instructions during activities.
  • All clients will be required to sign a Participant Release of Liability, Waiver of Claims, Assumption of Risks and Indemnity Agreement before participating in any trip. Parents or Guardians are required to sign for participants under 18 years of age.
  • Each client agrees and acknowledges when they sign up for an Unquote Travel activity that they have significant responsibility for their own safety and that they agree they are ULTIMATELY RESPONSIBLE for their own safety during participation in a tour.

Waiver of Liability

In consideration of the risk of injury while participating in travel (the “Activity”), and as consideration for the right to participate in the Activity, I hereby, for myself, my heirs, executors, administrators, assigns, or personal representatives, knowingly and voluntarily enter into this waiver and release of liability and hereby waive any and all rights, claims or causes of action of any kind whatsoever arising out of my participation in the Activity, and do hereby release and forever discharge Unquote Travel LLC, its affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors and assigns, for any physical or psychological injury, including but not limited to illness, paralysis, death, damages, economical or emotional loss, that I may suffer as a direct result of my participation in the aforementioned Activity, including traveling to and from an event related to this Activity.

I AM VOLUNTARILY PARTICIPATING IN THE AFOREMENTIONED ACTIVITY AND I AM PARTICIPATING IN THE ACTIVITY ENTIRELY AT MY OWN RISK. I AM AWARE OF THE RISKS ASSOCIATED WITH TRAVELING TO AND FROM AS WELL AS PARTICIPATING IN THIS ACTIVITY, WHICH MAY INCLUDE, BUT ARE NOT LIMITED TO, PHYSICAL OR PSYCHOLOGICAL INJURY, PAIN, SUFFERING, ILLNESS, DISFIGUREMENT, TEMPORARY OR PERMANENT DISABILITY (INCLUDING PARALYSIS), ECONOMIC OR EMOTIONAL LOSS, AND DEATH. I UNDERSTAND THAT THESE INJURIES OR OUTCOMES MAY ARISE FROM MY OWN OR OTHERS’ NEGLIGENCE, CONDITIONS RELATED TO TRAVEL, OR THE CONDITION OF THE ACTIVITY LOCATION(S). NONETHELESS, I ASSUME ALL RELATED RISKS, BOTH KNOWN OR UNKNOWN TO ME, OF MY PARTICIPATION IN THIS ACTIVITY, INCLUDING TRAVEL TO, FROM AND DURING THIS ACTIVITY.

I agree to indemnify and hold harmless Unquote Travel LLC against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my behalf, including attorney’s fees and any related costs, if litigation arises pursuant to any claims made by me or by anyone else acting on my behalf. If Unquote Travel LLC incurs any of these types of expenses, I agree to reimburse Unquote Travel LLC.

I acknowledge that Unquote Travel LLC and their directors, officers, volunteers, representatives and agents are not responsible for errors, omissions, acts or failures to act of any party or entity conducting a specific event or activity on behalf of Unquote Travel LLC.

I ACKNOWLEDGE THAT THIS ACTIVITY MAY INVOLVE A TEST OF A PERSON’S PHYSICAL AND MENTAL LIMITS AND MAY CARRY WITH IT THE POTENTIAL FOR DEATH, SERIOUS INJURY, AND PROPERTY LOSS. The risks may include, but are not limited to, those caused by terrain, facilities, temperature, weather, lack of hydration, condition of participants, equipment, vehicular traffic and actions of others, including but not limited to, participants, volunteers, spectators, coaches, event officials and event monitors, and/or producers of the event.

I ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS “WAIVER AND RELEASE” AND FULLY UNDERSTAND THAT IT IS A RELEASE OF LIABILITY. I EXPRESSLY AGREE TO RELEASE AND DISCHARGE Unquote Travel LLC AND ALL OF ITS AFFILIATES, MANAGERS, MEMBERS, AGENTS, ATTORNEYS, STAFF, VOLUNTEERS, HEIRS, REPRESENTATIVES, PREDECESSORS, SUCCESSORS AND ASSIGNS, FROM ANY AND ALL CLAIMS OR CAUSES OF ACTION AND I AGREE TO VOLUNTARILY GIVE UP OR WAIVE ANY RIGHT THAT I OTHERWISE HAVE TO BRING A LEGAL ACTION AGAINST Unquote Travel LLC FOR PERSONAL INJURY OR PROPERTY DAMAGE.

To the extent that statute or case law does not prohibit releases for negligence, this release is also for negligence on the part of Unquote Travel LLC, its agents, and employees.

In the event that I should require medical care or treatment, I agree to be financially responsible for any costs incurred as a result of such treatment. I am aware and understand that I should carry my own health insurance.

In the event that any damage to equipment or facilities occurs as a result of my or my family’s willful actions, neglect or recklessness, I acknowledge and agree to be held liable for any and all costs associated with any actions of neglect or recklessness.

This Agreement was entered into at arm’s-length, without duress or coercion, and is to be interpreted as an agreement between two parties of equal bargaining strength. Both the Participant and Unquote Travel LLC agree that this Agreement is clear and unambiguous as to its terms, and that no other evidence will be used or admitted to alter or explain the terms of this Agreement, but that it will be interpreted based on the language in accordance with the purposes for which it is entered into.

In the event that any provision contained within this Release of Liability shall be deemed to be severable or invalid, or if any term, condition, phrase or portion of this agreement shall be determined to be unlawful or otherwise unenforceable, the remainder of this agreement shall remain in full force and effect, so long as the clause severed does not affect the intent of the parties. If a court should find that any provision of this agreement to be invalid or unenforceable, but that by limiting said provision it would become valid and enforceable, then said provision shall be deemed to be written, construed and enforced as so limited.

Terms and Conditions

The following terms and conditions apply if you are joining one of our regularly scheduled trips listed in our catalog or on our website*:

Deposit Payments

A deposit of $250 per person, per tour is required to confirm a reservation. This may be paid with a Visa, MasterCard, American Express or personal check.

Confirmation Package

As soon as we receive your reservation and deposit, we will send you detailed information on what to bring, how to prepare for your trip, travel directions, detailed itinerary, trip cancellation insurance application, pre- and post-tour hotel information and Unquote Travel policies.

Balance Payments

The balance of the trip price is normally due 60 days before departure, payable by check or credit card. But please check each indevidual trip for balance due dates.

If you pay your deposit by credit card, you athorise us to charge your card for the balance due 60 days prior to departure, unless you instruct us otherwise in writing. If the balance is not paid when due, Unquote Travel reserves the right to regard the reservation as canceled.

Cancellations and Refunds

If you need to cancel your participation in a trip, you must notify us in writing. Each trip has its own deposit, payment, and cancellation schedules, so please see the trip policy for your trip to understand what is refundable and when.

Unquote Travel reserves the right to cancel a trip for any reason. In such an instance, we will refund all payments received, which will constitute full settlement.

Coupons and Discounts

Coupons and Discount Codes may only be used for multi-day tours. Only one coupon or discount code may be used per person and per tour.

Arrival and Departure

Each trip begins and ends in a town accessible by plane, train, boat or bus. Meeting and ending locations are listed in your pre-departure information. For some tours, it may be preferable to arrive at the starting point the night prior to the trip departure date. We will be happy to provide you with instructions on how to phone or fax the hotels yourself.

Accommodations

Trip prices are based on two people per room. If you are traveling alone, we will assign you a roommate of the same gender, or you can choose to room alone, paying the single supplement. There are a limited number of single rooms available on all trips. If you choose to be paired with a roommate and we are unable to pair you, we will invoice you for the single supplement 60 days prior to the trip. If we are subsequently able to find you a roommate, we will gladly refund the single supplement.

If unforeseen circumstances require a change to the trip itinerary, Unquote Travel will make every effort to select alternative hotels of the same standard and to keep modifications to a minimum.

Insurance

We include in all Deposit and Final Confirmation Packages an application form for short-term travel insurance that offers you options to cover baggage, accident/ life and/or trip cancellation. Trip cancellation insurance reimburses you for non-refundable air and land costs, if you have to cancel a trip due to personal or family illness or accident. The insurance that we recommend also provides coverage for all pre-existing conditions if you complete your insurance form and postmark it within seven calendar days of our receipt of your deposit. We highly recommend that you obtain this insurance.

Children

All minors must be accompanied by an adult.

Responsibility and Release

You are responsible for choosing a trip that fits your abilities, level of fitness and health. If you need any assistance in selecting the right trip for you, please contact Unquote Travel. You are also responsible for reading the pre-trip information material and bringing with you all of the appropriate clothing and equipment, as well as acting in accordance with the customs and laws of the regions visited. Unquote Travel reserves the right to accept, remove, retain or decline any trip member at any time for any reason. In such case, a refund equal to the actual cost of the unused services is the limit of Unquote Travel responsibility.

Payment of your deposit represents your acceptance of the following terms and conditions, as well as all general information listed in the catalog, online at www.UnquoteTravel.com and subsequent trip departure material: Unquote Travel LLC, its members, employees, and agents give notice that all services and arrangements related to this tour have been made by Unquote Travel, LLC only as agents upon the express condition that Unquote Travel, LLC shall not be liable and does not assume responsibility for any claims, damages, expenses or other financial loss whether to person or property arising out of any injury, accident, death, cancellation, delay, alteration, or inconvenience resulting from any act of omission, commission or inadvertence of any hotel, carrier, restaurant or other company or person rendering any of the services included in the tour or its pre and post tour arrangements, or caused by weather, sickness, strikes, quarantines or the willful or negligent acts of any other tour members or any cause whatsoever beyond the control of Unquote Travel.

Some days or activities and certain trips are operated by local tour operators contracted with Unquote Travel, LLC. These operators have been selected for the quality of the services and tours they offer as well as the desirability of the destinations.

Unquote Travel, LLC reserves the right and trip participants agree to allow Unquote Travel to take photographic or film records of any of our trips and trip participants, and may use any such records for promotional and/or commercial purpose.
